LIVECAST.PRO Terms of Service
Version terms-2026-09-12. Effective Date: September 12, 2026. This version replaces the Terms of Service dated June 1, 2023.
These Terms govern your use of Livecast services, including the "Video On Demand", "Livecast Rebroadcast" and "Livestream" platforms (the "Services"). Livecast.pro is operated by PROFIGROUP LLC, UBI 605 297 917, 600 1st Avenue, Ste 102 PMB 2397, Seattle, WA 98104, United States ("Livecast"). By using the Services you agree to them.
1. The documents
1.1 These Terms come with the Seller Addendum if you sell, the Viewer Agreement if you watch or buy, and the Privacy Policy. The four are one agreement. Each shows a version identifier and an effective date under its title, so either side can tell which text was in force; that identifier is what Livecast records when a seller agrees to them.
1.2 If the four disagree, the Seller Addendum governs a seller's sales, the Viewer Agreement governs a viewer's purchases, and these Terms govern the rest.
2. What Livecast is
2.1 Livecast is a platform. Sellers publish streams and videos on it and may charge viewers for access or take donations. Livecast is not the seller of that content and is not the merchant of record for those payments. The payment is created on the seller's own Stripe account and the money is the seller's; Livecast charges the seller a fee, set out in the Seller Addendum.
2.2 Livecast is the seller, and answerable as such, for what you buy from Livecast itself: plans, additional storage and balance top-ups.
2.3 Livecast does not review what a seller publishes before it appears. It may remove content and suspend selling under clause 5.
3. Accounts and use of the Services
3.1 Some features need an account; give accurate information and keep it current. You do not need an account to buy access to a single piece of content. You must be at least 13 to create one, and under 13 may use the Services only with the consent and supervision of a parent or legal guardian.
3.2 To sell you must be old enough to enter a binding contract where you live and able to hold a Stripe account. Stripe, not Livecast, decides whether you may.
3.3 When using the Services you agree not to:
(b) Engage in any activity that could harm or interfere with the proper functioning of the Services or others' use of them;
(c) Circumvent, disable, or otherwise interfere with security features of the Services;
(d) Attempt to gain unauthorized access to our systems or other users' accounts;
(e) Use automated means to access the Services, except for search engine indexing;
(f) Transmit viruses, malware, or harmful code through the Services;
(g) Use the Services for any illegal, fraudulent, or harmful purpose;
(h) Impersonate any person or entity, or misrepresent your affiliation with one;
(i) Collect or store personal information about other users without their consent;
(j) Distribute, transmit or display content that is unlawful, harmful, threatening, abusive, defamatory or otherwise objectionable under the laws on prohibited content on the Internet;
(k) Share, publish or resell an access code, or use one you were not sold;
(l) Use a sale or a donation to move money rather than to deliver content, including buying your own content.
4. Content
4.1 You retain ownership of all content you upload, post or transmit through the Services ("Your Content"). By uploading it you grant Livecast a non-exclusive, worldwide, royalty-free, sublicensable and transferable licence to use, reproduce, distribute, publicly perform and display Your Content in connection with the Services, subject to the Privacy Policy.
4.2 You may not use, distribute or sell content you do not own unless the rights holder permits it, and you may not remove or obscure any copyright, trademark or other proprietary notice.
5. Suspension and termination
5.1 Livecast may remove content, switch off selling on it, and suspend or end your access if we believe you have broken these Terms or acted unlawfully, harmfully or abusively. We will make reasonable efforts to notify you first, except where immediate action is needed for security.
5.2 You may stop using the Services at any time; to close your account write to info@profigroup.llc. Closing it does not end the licence in clause 4.1, does not cancel sales already made or access already bought, and does not close your Stripe account, which stays yours.
6. Warranties, liability and indemnity
6.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. LIVECAST IS NOT RESPONSIBLE FOR LOSS OF ACCESS CAUSED BY THIRD PARTY INTERNET PROVIDERS, DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND DOES NOT WARRANT CONTENT SOLD BY A SELLER.
6.2 IN NO EVENT SHALL LIVECAST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICES. NOTHING HERE EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING TO A CONSUMER.
6.3 You agree to indemnify Livecast and its officers, directors, employees, agents and affiliates against claims, losses, liabilities, damages, costs and expenses, including attorneys' fees, arising from your use of the Services, your breach of these Terms, or your violation of another party's rights. This does not apply to you as a consumer buying access to content.
7. Changes, governing law and contact
7.1 Livecast may modify these Terms. The current version is posted here with a new version identifier and effective date; using the Services after that date is acceptance. A seller who agreed to an earlier version is asked to agree again the next time they connect a Stripe account.
7.2 These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules, and the courts of King County, Washington have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live.
7.3 These four documents are the entire agreement between you and Livecast on their subject matter, unless a separate written agreement with Livecast says otherwise.
