LIVECAST.PRO Terms of Service

Welcome to Livecast! These Terms of Service ("Terms") govern your use of Livecast services, including but not limited to the "Video On Demand" the "Livecast Rebroadcast" and the "Livestream" platform (collectively referred to as the "Services"). By accessing or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Account Registration and Eligibility

1.1 Account Creation: To access and use certain features of our Services, you may be required to create an account. You must provide accurate and complete information during the registration process and keep your account information up to date.

1.2 Eligibility: You must be at least 13 years old to create an account and use our Services. If you are under 13, you may only use our Services with the consent and supervision of a parent or legal guardian.

Use of Services

2.1 Subject to these Terms, Livecast grants you a possibility to access and use the Services.

2.2 Prohibited Activities: When using our Services, you agree not to:

(a) Violate any applicable laws, regulations, or third-party rights;

(b) Engage in any activity that could harm or interfere with the proper functioning of our Services or others' use of the Services;

(d) Attempt to gain unauthorized access to our systems or accounts of other users;

(e) Use automated means to access our Services, except for search engine indexing purposes;

(f) Transmit any viruses, malware, or harmful code through the Services;

(g) Use the Services for any illegal, fraudulent, or harmful purpose;

(h) Violate any applicable guidelines or policies provided by Livecast;

(i) Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(j) Collect or store personal information about other users without their consent;

(k) Use the Services to distribute, transmit, or display any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable according to the laws on prohibited content on the Internet.

Content Ownership and Licenses

3.1 Your Content: You retain ownership of all content you upload, post, or transmit through our Services ("livecast.pro"). By uploading Your Content, you grant Livecast a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, publicly perform, and display Your Content in connection with the Services, subject to our Privacy Policy.

3.2 Content: All content, including but not limited to videos, images, graphics, text, and logos, is protected by copyright, trademark, and other intellectual property laws. You may not Use, distribute, sell, or otherwise interact with copyrighted content unless the content is owned by you or you do not have permission to use it from the author of the content.

Intellectual Property Rights

4.1 Intellectual Property: All intellectual property rights in the Services and Content are owned belong to their rightful owners. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the Services or Livecast Content.

4.2 Feedback: If you provide Livecast with any feedback, suggestions, or ideas regarding the Services, you grant Livecast a non-exclusive, perpetual, irrevocable, royalty-free license to use, disclose, reproduce, modify, sublicense, and otherwise exploit the feedback without any compensation or obligation to you.

Suspension and Termination

5.1 Suspension: Livecast may suspend or terminate your access to the Services if we believe that you have violated these Terms or engaged in any unlawful, harmful, or abusive behavior. We will make reasonable efforts to notify you before taking any action, except in cases where immediate action is necessary for security reasons.

5.2 Termination: You may stop using our Services at any time. If you wish to terminate your account, please contact us at support@livecast.com. Please note that terminating your account will not affect the rights granted to Livecast under Section 3.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. LIVECAST DISCLAIMS ALL WARRANTIES FOR THE SUCCESSFUL DISTRIBUTION OF YOUR CONTENT, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. LIVECAST IS NOT RESPONSIBLE FOR THE LACK OF ACCESS TO CONTENT DUE TO INTERNET CONNECTION LOSS OR OTHER PROBLEMS (INTERNET PROVIDERS) OF THIRD PARTY ORGANIZATIONS PROVIDING INTERNET ACCESS SERVICES TO OUR CUSTOMERS, AS WELL AS THE SERVICES WILL BE UNINTERRUPTED AND WITHOUT ERROR OR HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT SHALL LIVECAST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICES LIVECAST.PRO

Indemnification

You agree to indemnify and hold Livecast, its officers, directors, employees, agents, and affiliates harmless from any and all claims, losses, liabilities, damages, costs, and expenses, including attorneys' fees, arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another party.

Modifications to the Terms

Livecast reserves the right to modify these Terms at any time. We will post the most current version on our website, and the Effective Date will indicate the latest revision. Your continued use of the Services after the posting of any changes constitutes your acceptance of such changes.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United State.

Entire Agreement

These Terms constitute the entire agreement between you and Livecast concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, whether oral or written.
